Federal Case
Niyato Industries
According to court documents, Broyles, also known as Dan Thomas, took part in a high-yield investment fraud scheme involving Niyato Industries Inc., a sham company. He conspired with Niyato's chief executive, Robert Leslie Stencil of Charlotte, North Carolina, and others to sell Niyato stock. They portrayed Niyato as a leader in manufacturing electric vehicles and converting gasoline vehicles to run on compressed natural gas. In reality, Broyles knew, or intentionally avoided learning, that Niyato lacked any operational facilities or proprietary technology.[2][4]
The Niyato case was brought in the Western District of North Carolina. The indictment charged Broyles with one count of conspiracy to commit mail and wire fraud, 14 counts of mail fraud, 14 counts of wire fraud and five counts of money laundering.[3] Seven other defendants were convicted in connection with Niyato. Stencil was convicted after a three-week jury trial and sentenced to 12 years and three months in prison.[2]
EarthWater
Broyles also took part in a second scheme involving EarthWater Limited. He conspired with EarthWater's chief executive, Cengiz Jan Comu of Dallas, and others to sell EarthWater stock. According to the Justice Department, investors were told that EarthWater used their money to develop and operate its business. In fact, Broyles, Comu and their co-conspirators had agreed to use the funds largely for their personal benefit.[2] The EarthWater case was brought in the Northern District of Texas. Eleven other defendants pleaded guilty in connection with EarthWater, and Comu was sentenced to 10 years in prison.[3][2]
The Justice Department said the two schemes defrauded elderly and other vulnerable victims out of millions of dollars.[2]
Extradition, plea and sentence
Broyles was extradited from Mexico on March 8, 2022, with assistance from the Government of Mexico, and made his initial appearance in federal court in Charlotte the next day.[3][4] The June 2022 plea announcement also lists the alias Daniel Cruz Torrez.[4]
On June 24, 2022, Broyles pleaded guilty to one count of conspiracy to commit mail and wire fraud, one count of mail fraud and one count of money laundering in the Niyato case, and to one count of conspiracy to commit mail and wire fraud in the EarthWater case.[4] He was sentenced on January 4, 2024, to four years in prison. The U.S. Postal Inspection Service investigated both cases.[2]
Federal Reality Consulting
Broyles operates Federal Reality Consulting from Malibu, California. He presents it as direct access to him personally rather than as a firm with staff.[1] The practice advises defendants facing federal charges and their families on what to expect from the federal system, drawing on his own path through extradition, county jail, federal detention, transport and a federal prison camp.[1]
The website offers a free initial conversation. It states that Broyles is not an attorney, does not practice law and does not make legal decisions for clients. It also says no consultant can control the outcome of a case. The site cautions readers against consultants who promise results such as sentence reductions, Residential Drug Abuse Program (RDAP) admission, First Step Act credits, preferred placement or early release.[1] It states that his federal case is a matter of public record and invites prospective clients to look it up.[1]
